Expect to be Denied When You Apply for Social Security Disability benefits


The majority, about 65%, of initial Social Security disability applications are denied. If you apply for disability benefits and are awarded right away, you should be really excited! One of two things may have happened. Firstyou had a clear-cut disability that fit the criteria written in the Social Security Administration's guidebook, or, secondly, you could have had a very good lawyer.

If your disability application was denied then you fit in with most people. This is not the time to get upset or blame your doctors or even a lawyer if you had one. However, it is time to look at your denial letter and see the reason for the denial. You now know exactly what you have to focus on during your appeal in order to win the benefits you deserve. But before you begin working on obtaining documentation and try to explain your side, you should immediately follow the instructions provided in the letter to appeal the decision. You only have sixty days from the time you received the letter to file an appeal notice, otherwise you may have to start all over again. Don't procrastinate! It may be several months before your appeal will be reviewed, so you have time to gather the additional information after you file the appeal notice.

Do I need to fire my lawyer if I was denied Benefits a second time?

We would like to say, "Yes, " if you are using an advocate or law firm other than the Cochran Firm Disability Lawyers, but that may not be the correct answer. During the hearing, your testimony will be evaluated along with the testimony of SSA witnesses such as vocational experts who may tell the judge you are capable of working and even provide a list of jobs they feel you can do. All of the government witnesses are at the hearing for one purpose- to keep you from receiving your benefits. A good lawyer can refute their testimony and cross examine the witnesses in a strong effort to persuade the judge to rule on your behalf.
